Travel agencies: From 1st July, the cancellation penalty is cancelled and the compensatory tour shall not be mandatory

Tour operators, travel agencies, carriers - 3 working days until the effectiveness of principal changes in the sale of tourism services. Each day a new post, each day a list of five important changes.
1) Cancellation penalty – The obligation of the tour organizer to pay the customer a cancellation penalty in the amount of 10% of the tour price if the tour is cancelled within the time-limit shorter than 20 days before the tour start is hereby repealed without any substitution
2) Withdrawal – The customer is entitled to withdraw from the travel contract even in the course of the tour in the event of substantial defects.
3) Application for license – The tour operator applying for a license to procure the sale of related travel services must specify in the application the services comprised by the related travel services procured, for which the operator shall collect payments directly from customers.
4) Compensatory tour – In the event of a withdrawal of the customer from the travel contract due to substantial changes and in the event of withdrawal from the tour by the operator, the operator has no obligation to offer the customer the so-called compensatory tour.
5) Changing the tour price – The travel operator may not reserve the right to increase the tour price without simultaneously admitting the customer’s right for reduction thereof.
Changes introduced by amendment to Act No. 159/1999 Coll. may affect fundamentally many businesses in the tourist industry. We recommend entrepreneurs to analyze tourism services they offer their customers in order to determine whether they sell a tour, RTS, or other tourism services.
