Claims of clients of bankrupt travel agencies
Court upholds first claim of client of bankrupt travel agency against insurance company.
The law firm Holubová-advokáti s.r.o. is representing clients of bankrupt travel agencies who were not paid out the full price of purchased tour packages by insurance companies. In April 2012, Holubová-advokáti s.r.o. filed a total of 10 claims against the insurance company Generali.
On 27 March 2013, the court ruled on one of the ten legal proceedings. The court agreed with the claimant’s arguments and decided in favour of the client, specifically that Generali insurance company is obliged to pay out the full price of the purchased package tour as the benefit. The ruling was issued in a matter where an appeal is not permissible; therefore, the ruling will be deemed final upon its being delivered in writing.
The courts are obliged to rule on similar cases in the same way. Holubová-advokáti s.r.o. therefore believes that the other claims will be successful. Holubová-advokáti s.r.o. has set up a special email address – hromadna@holubova.cz – to deal with the requests for legal services from clients of bankrupt travel agencies.

Subsequently, we assisted the client with related tax issues and contacted Auditone, a tax consultancy firm, which arranged for the filing of a tax return. Compensation for lost income is taxable, unlike most personal injury compensation.
